The minister has been facing repeated calls for him to resign following the revelation that his campaign for the deputy leadership had not declared a number of financial donations.
In a statement issued through his lawyer, Hain said "I am surprised that wanting to stay in my job is not a valid defence for my illegal actions. Clearly, new legislation is required to close this archaic loophole in our legal system".
The defence is remarkably similar to that offer by Gordon Brown last October - to some effect - when everyone else said he was shit.
